Terms of Use
These terms are the agreement between you and Felix-Vita, Inc. ("Fanfare", "we", "us") for the Fanfare app. Please read them; by installing or using Fanfare you accept them. Our Privacy Policy explains how we handle information and is part of these terms.
1. Who can use Fanfare
You must be at least 18 years old and located in the United States. Fanfare is published on the App Store and Google Play for the United States only. You may make cards for people of any age, but the account is yours and you are responsible for it.
2. What Fanfare does
Fanfare reminds you of birthdays in your contacts and helps you make a personalized card: a message and artwork generated by AI services, in English or Colombian Spanish, with your signature. You send the card yourself (for example through WhatsApp, iMessage or Photos). Fanfare never sends, posts or delivers anything on your behalf.
3. Your account
Fanfare creates an anonymous account on your device. You may optionally sign in with an email to sync across devices. You are responsible for the devices you use Fanfare on and for anything done from your account. You can delete your account at any time from inside the app (see Delete your account).
4. Wallet, prices and free cards
- Prepaid wallet. Fanfare uses a prepaid balance in US dollars. You add money in fixed amounts ($5, $10, $25 or $50) and cards are paid from that balance. The wallet is not a bank account, earns no interest and has no cash value outside Fanfare.
- Price. A card costs $1.00. That price includes the first version and up to 3 changes ("Try again") to the same card, as long as they are made within 24 hours of the first version. After the 3 changes, or after 24 hours, a new card is a new $1.
- Free trial. Each account gets 3 free cards, once. They are used before any paid balance and include the same 3 changes.
- Failed cards. If a card cannot be made, you are not charged for it, and a change that fails does not count against your 3.
- Payment methods. On iPhone, top-ups are processed by Stripe in your browser. On Android, top-ups are processed by Google Play Billing. Their terms apply to the payment itself. Applicable taxes may be added by the payment provider.
- Non-transferable. Balances and free cards belong to the account that received them. They cannot be transferred to another account or person, exchanged for cash, or resold.
- Price changes. We may change prices. The current price is always shown in the app before you spend, and a change never affects money already in your wallet except by changing what it buys going forward.
Refunds
Your balance is for cards in Fanfare. Money you add to your wallet can be used for any card and does not expire. In this first version of Fanfare, wallet balance cannot be withdrawn, transferred, or refunded to your payment method, except where the law requires it. A card that fails to generate is never charged. Top-ups bought through Google Play are also subject to Google's own refund policy. If Google or your bank reverses a payment, we remove that amount from your wallet balance, down to zero, even if part of it was already used. We may suspend accounts that repeatedly reverse payments for cards already created. Deleting your account forfeits any remaining balance.
5. AI-generated content
Messages and artwork are generated by third-party AI services (OpenAI, Google and Anthropic), based on the details you provide. AI output can be inaccurate, odd or unlike what you expected, and the same request can produce different results. You review every card before you share it, and you decide whether to share it. We don't guarantee that a card will be accurate, appropriate or suitable for any purpose. If a card is offensive or wrong, use Report this card in the app so we can review it.
6. Your content
- What you provide. You keep all rights to the names, notes and photos you provide. You give us a limited license to process them, including through the AI providers described in the Privacy Policy, for the sole purpose of making the card you asked for.
- Photos of other people. By attaching a photo you confirm you have the right to use it and, if it shows a child, the permission of the child's parent or guardian.
- The cards. We do not claim ownership of the cards you make. To the extent AI output can be owned, it's yours, and you may share it for personal, non-commercial purposes. Rights in AI output can be limited by law and by the providers' terms.
7. Acceptable use
You agree not to use Fanfare to:
- create sexual content, and in particular any sexual or suggestive content involving a minor;
- create content that harasses, threatens, demeans or targets anyone, or that is hateful toward a group;
- create violent or gory content;
- use someone's photo or likeness without their permission (or their parent or guardian's, for a child), or create misleading images of real people;
- break any law or anyone's rights, including privacy and intellectual property;
- try to bypass the safety checks, abuse the free trial, or use scripts or automation against our service;
- resell, transfer or trade wallet balances or free cards.
Every card request goes through an automated safety check; flagged requests are refused. We may suspend or close an account that breaks these rules, and in that case any remaining balance may be forfeited to the extent allowed by law.
8. Our intellectual property
The Fanfare name, logo, app and design are ours or our licensors'. These terms don't give you any right to use them except to use the app as intended.
9. Third-party services
Stripe, Google Play, Apple and the AI providers are independent companies with their own terms and policies. Your use of their services is governed by those terms. Apple and Google are not responsible for Fanfare or for any support, maintenance or warranty of it.
10. Disclaimers
Fanfare is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the app will be uninterrupted, error-free, or that any card will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of Fanfare. Our total liability for any claim relating to Fanfare is limited to the amount you paid us in the 12 months before the claim. Some states don't allow these limits, so they may not apply to you.
12. Ending the agreement
You can stop using Fanfare and delete your account at any time. We may suspend or end your access if you break these terms or if we discontinue the service; where reasonable we will give notice and a chance to use your balance.
13. Governing law and disputes
These terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules. If you have a problem, please contact us first at support@myfanfare.app — most issues can be fixed quickly. Any dispute that can't be resolved that way will be decided by the state or federal courts located in Delaware, and you and we agree to their jurisdiction. Either of us may instead bring an individual claim in small claims court in the county where you live, if the claim qualifies. Nothing in these terms limits rights you have under the consumer protection laws of the state where you live.
14. Changes to these terms
We may update these terms. We will change the date at the top and, for material changes, tell you in the app. Continuing to use Fanfare after a change means you accept the new terms.
